On April 30, 2018, the California Supreme Court issued its decision in Dynamex Operations West v. S.C. (Lee et al.), marking a landmark shift in what employers must now show to properly classify workers as independent contractors under California law. The Court rejected the Borellotest and instead adopted a modified “ABC” test, similar to that used in Massachusetts, for determining whether an individual is an employee under California Wage Orders. In light of this case, any businesses operating in California that treat workers as independent contractors should re-evaluate their workers under California’s new “ABC” test in order to make urgent and informed decisions around any necessary reclassifications and accompanying strategies.
